Viacom and YouTube disclose a whole lot of documents. To summarize:
- Viacom says that YouTube is essentially “Napster in Video” and the precedent is for them to be shut down.
- YouTube is - smoking gun! - alleging that Viacom’s own marketing employees and agencies were uploading videos to YouTube.
I cannot comment on that, but back in the day, I recall that Forbes’ Marketing department would email us with lists to add to our Top 10 list section and then their lawyers would email us a week later saying “please take the list down”. I would then email both parties, include each one’s emails and say “please discuss and get back to me”… so it is possible.
